Terms of Service

1. Who we are

nameitnow ("nameitnow", "we", "us") operates the website at nameitnow.co and the name-generation service available there (the "Service"). You can reach us at any time at support@nameitnow.co.

By using the Service you agree to these Terms. If you do not agree with them, please do not use the Service.

2. What the Service does

You describe a business, and the Service uses an AI model to generate candidate names. For each candidate it queries a domain registrar to report whether the corresponding domain names appear to be available for registration.

The Service reports availability information. It does not register, reserve, purchase or hold any domain name on your behalf, and it creates no rights of any kind in a name or a domain.

3. Availability information is a point-in-time snapshot

A domain shown as available can be registered by someone else seconds later. Availability is checked at the moment you run a search and is accurate only for that moment. We make no promise that any domain will still be available when you go to register it, nor at what price.

We query the registrar directly and report a domain as available only when the registrar explicitly says so; any error, timeout or ambiguous answer is reported as unavailable. This is deliberately conservative, and it means the Service may sometimes omit a name that is in fact free.

Some available domains are priced by the registry at a substantial premium over the standard rate for that extension. The Service does not display registration prices, and a domain shown as available may cost far more than you expect. Always check the price with your registrar before purchasing.

4. Names are machine-generated — clearance is your responsibility

Generated names are produced automatically by an AI model. They are not reviewed by a person, and they may coincide with existing company names, trade marks, or the names of real businesses, products or people.

We do not conduct trade mark, company registry or any other legal clearance search, and nothing in the Service is legal advice. Before you adopt a name or register a domain, you are responsible for carrying out your own clearance and, where appropriate, taking professional advice. You alone bear the consequences of adopting a name.

We claim no ownership of the names generated for you, and we do not guarantee that a name is unique or that others will not be shown the same name.

5. Accounts

You can use the Service without an account. If you create one, you are responsible for keeping your password confidential and for activity that takes place under your account. Tell us promptly at support@nameitnow.co if you believe your account has been compromised.

You must be at least 16 years old, or the age of digital consent where you live, whichever is higher.

6. Plans and payment

Prices are in US dollars and are shown on the pricing page before you buy. Payments are handled by our payment processor, Stripe; we never receive or store your full card details. You are responsible for any taxes that apply to your purchase.

You may cancel a Studio subscription at any time; it will remain active until the end of the period you have paid for and will not renew after that. Refunds are covered by our Refund Policy, which forms part of these Terms.

We may change our prices. A change never affects a purchase you have already made, and for subscriptions we will tell you before the change takes effect.

We may suspend or terminate access that breaches this section. Where we do so and you hold unused paid credit, we will refund it unless the breach was deliberate.

8. Availability of the Service

We aim to keep the Service running but do not guarantee that it will be uninterrupted or error-free. The Service depends on third parties — an AI provider, a domain registrar and a hosting provider — and may be unavailable when they are. We may change, suspend or discontinue any part of the Service; if we discontinue it entirely, we will refund unused paid credit.

9. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost business, lost opportunity, or the cost of a domain you did or did not register.

Our total liability to you for all claims arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or US$50.

Nothing in these Terms excludes any liability that cannot lawfully be excluded, and if you are a consumer, your statutory rights are not affected.

11. Your content

You keep all rights in the descriptions and keywords you enter. You grant us permission to process them for the purpose of operating the Service — which includes sending them to our AI provider to generate names. How we handle this is set out in our Privacy Policy.

12. Changes to these Terms

We may update these Terms. The date at the top of this page shows when they last changed, and the current version always governs your use of the Service. If a change is significant and you hold an active paid plan, we will make reasonable efforts to tell you.

13. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware, except that either of us may seek injunctive relief in any court of competent jurisdiction.
